1. Agreement to Terms

By accessing or using NUGGET CLUB's website, products, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and NUGGET CLUB regarding your use of the Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• You reside in the United States (we currently only ship within the US)
• All information you provide is accurate, complete, and current
• You are not prohibited from receiving our products under applicable law

3. Subscription Services

3.1 Subscription Terms

NUGGET CLUB offers monthly subscription services for natural gold nuggets. By subscribing, you agree to:

• Pay the monthly subscription fee for your selected tier
• Provide accurate shipping and billing information
• Authorize us to charge your payment method monthly
• Accept that gold weights are approximate and naturally vary

3.2 Subscription Tiers

We currently offer five subscription tiers:

• Starter Nugget: ~0.25g - $49/month
• Explorer Box: ~0.5g - $99/month
• Prospector Box: ~1g - $199/month
• Collector Box: ~2g - $399/month
• Mogul Box: ~4g - $799/month

Gold weights are approximate and represent the minimum expected value. Due to the natural variation in gold nuggets, actual weights may vary slightly from month to month.

3.3 Billing and Renewal

• Subscriptions automatically renew monthly unless cancelled
• Billing occurs on the same date each month (subscription anniversary)
• You authorize us to charge your payment method for all subscription fees
• Failed payments may result in subscription suspension
• Price changes will be notified 30 days in advance

4. Cancellation and Refunds

4.1 Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellations take effect at the end of the current billing period.

• No cancellation fees or penalties
• You retain access until the end of your paid period
• Reactivation is available at any time (subject to current pricing)

4.2 ALL SALES ARE FINAL - NO REFUNDS

ALL SALES ARE FINAL. DUE TO THE NATURE OF PRECIOUS METALS AND GOLD PRICE VOLATILITY, WE DO NOT OFFER REFUNDS, RETURNS, OR EXCHANGES UNDER ANY CIRCUMSTANCES.

By purchasing from NUGGET CLUB, you acknowledge and agree to the following:

• No Refunds: Once an order is placed and payment is processed, the sale is final. No refunds will be issued for any reason including but not limited to buyer's remorse, change of mind, or gold price fluctuations.
• No Returns: We do not accept returns of any gold nuggets or precious metal products. All sales are final at the time of purchase.
• No Exchanges: We do not offer exchanges for different products, sizes, or weights.
• Price Volatility: You understand that gold prices fluctuate daily. The value of your purchase may increase or decrease after your transaction. We are not responsible for any financial loss due to market price changes.
• Natural Variation: Gold nuggets are natural products with inherent variations in size, shape, color, and texture. By purchasing, you accept that your nuggets will be unique and may differ from product images.
• Damaged in Transit: If your package arrives damaged, you must file a claim with the shipping carrier. We provide tracking and insurance, but all claims must go through the carrier. We are not responsible for carrier handling.

This no-refund policy is standard in the precious metals industry and is necessary to protect against fraud, market manipulation, and price volatility. We strongly encourage you to carefully review all product descriptions, pricing, and subscription terms before completing your purchase.

5. Shipping and Delivery

5.1 Shipping Terms

• Free shipping on all subscription boxes within the United States
• Orders typically ship within 1-2 business days
• Delivery times vary by location (typically 3-7 business days)
• Tracking information provided via email
• Signature may be required for high-value shipments

5.2 Risk of Loss

All shipments are insured. Risk of loss passes to you upon delivery. If a package is lost in transit, we will file a claim with the carrier and either replace your order or provide a refund.

5.3 Address Changes

You are responsible for maintaining accurate shipping information. Changes must be made at least 5 days before your next shipment date to take effect.

6. Product Authenticity and Quality

6.1 Authenticity Guarantee

We guarantee that all gold nuggets sold through NUGGET CLUB are 100% authentic, natural gold. Each shipment includes a certificate of authenticity. If you believe a product is not authentic, contact us immediately for investigation and replacement.

6.2 Natural Variation

Gold nuggets are natural products and will vary in size, shape, color, and texture. Product images on our website are representative but your actual nuggets will be unique. This natural variation is part of the value and appeal of collecting authentic gold specimens.

7. Prohibited Activities

You agree not to:

• Use our Services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with other users' access to our Services
• Use automated means to access our Services without permission
• Resell products purchased through NUGGET CLUB without authorization
• Submit false or misleading information
• Violate any applicable laws or regulations

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of NUGGET CLUB or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not use, reproduce, distribute, or create derivative works from our content without our express written permission.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUGGET CLUB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, our Services
• Any conduct or content of any third party on our Services
• Unauthorized access, use, or alteration of your transmissions or content
• Fluctuations in gold market value

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless NUGGET CLUB and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising from these Terms or our Services shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Delaware in accordance with the American Arbitration Association rules.

13. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our Services after changes constitutes acceptance of the modified Terms. Material changes will be notified via email or prominent notice on our website.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and NUGGET CLUB regarding your use of our Services.
